MUST Hosts International Forum on Creative Commons and Copyright Protection

Hosted by Faculty of Law, Macau University of Science and Technology (MUST), and organized by CC Macau project team, the International Forum on Creative Commons and Copyright Protection was held at N101, Library building of MUST on April 26th, 2012.
The recent years have witnessed Macao SAR government’s continuous efforts to promote moderate industrial diversification. The Policy Address for the fiscal year 2012 also indicates that the cultural and creative industries (CCI) of Macao have entered the initial stage of development. The development of CCI requires various support measures. Platforms need be provided for the local creators to show their talents, and legal systems need be perfected to enable reasonable use of the works and ensure protection of copyright. Creative Commons (CC) organization, originally established in the USA, has been devoted to building a reasonably layered and flexible mechanism for protecting copyright and sharing works. CC provides a new mentality for research and improvement of Intellectual Property (IP) Right and can meet the demand for legal protection of developing CCI in Macao. On the other hand, the digital age has raised new issues about copyright protection and its limitation. The CC licenses, being the creation of the internet world, provide more options for both copyright protection and reasonable use of works in the digital environment.
Experts and scholars in IP field, local professionals engaged in CCI and related industries, and members of other jurisdiction teams including China Mainland, Hong Kong, Taiwan, Portugal, Korea, etc. have gathered at this forum for intellectual exchange. Participants shared their experiences and opinions on topics of The Status Quo and Development Trend of CC, The Development of Cultural and Creative Industries and CC, Limitations and Exceptions to Copyright Protection in the Digital Environment, and Cross-border Cooperation on IP Protection during the one-day forum. This forum is believed to have a positive impact on both the development of local CCI and the exchange between Macao and other jurisdictions in terms of CCI.
Lecturing Professor Liu Liang, Vice Rector of MUST, participated in the forum and delivered a welcome address. There are guests from other CC Jurisdiction teams: CC Mainland Team Leader, Associate Professor Wang Chunyan, Law School, Renmin University of China; Mr. Zhu Handong, CC Mainland Project Manager and Photographer, Mr. Pindar Wong, Public Lead of CC Hong Kong; Legal Lead of CC Taiwan, Assistant Professor Lee Jyh-An, National Chengchi University; Assistant research specialist Zhang Yihong, CC Taiwan; Miss Teresa, Legal Lead of CC Portugal and Mr. Jae Yeon Kim from CC Korea. CC Macau team leader and public lead Associate professor Fang Quan, Assistant Dean of Faculty of Law, MUST, and legal lead Assistant Professor Yi Zaicheng, together with other members including Dr. HON Chi Tin, Associate Professor Wang Lan, Assistant Professor Shen Yunqiao, Miss Wang Chengfang and Miss Tang Xi attended the forum.

“創意共用與著作權保護”國際論壇成功舉辦

由澳門科技大學法學院主辦、“澳門創意共用”項目組承辦的“創意共用與著作權保護”國際論壇於2012年4月26日假澳門科技大學圖書館大樓N101會議廳舉行。
近年來,澳門政府一直堅持產業適度多元化發展的方針,2012 財政年度施政報告中亦已指出,澳門的文化創意產業已進入初級階段。文創產業的發展需要多方面的配套措施,既要為本地創作人提供更多表達平臺,更需要有好的作品合理使用和保護制度。源於美國的創意共用組織旨在建立一個層次合理而富有彈性的著作權保護和作品合理使用機制,為知識產權的研究和發展提供了新的思路,這正與澳門發展文創產業的法律保護需求相契合。另一方面,網路時代對著作權的保護與限制提出了新的課題,作為一種主要依託網路為應用平臺的協定機制,創意共用為網路時代作品的保護和合理使用提供了更多選擇。
本次國際論壇邀請到知識產權法領域的專家學者、本地文創人士和相關領域專業人士,以及來自中國大陸、香港、臺灣、葡萄牙、韓國等多個法域的創意共用組織成員出席會議,分別就“創意共用的現狀與趨勢”、“文化創意產業發展與創意共用”、“網路環境下著作權保護的限制與例外”及“跨域知識產權的法律協作”等四個主題展開了富於創見而卓有成效的交流和討論,相信能為今後澳門本地文創產業的發展及與其他法域的文創交流產生積極影響。

“網絡作品共用與知識產權保護”研討會

由澳門科技大學法學院主辦的“網絡作品共用與知識產權保護”論壇于2011年12月9日下午3點假澳門科技大學圖書館大樓N317報告廳舉行。近年來,澳門政府一直堅持產業適度多元化發展的方針,新近發佈的2012 財政年度施政報告指出,澳門的文化創意產業已進入初級階段。而伴隨網絡時代的全面展開,網絡作品的使用及其知識產權保護理應成為亟待關注與解決的問題。本地文創人士及相關領域專業人士出席會議,共同探討對網絡作品的合法使用及對網絡作品知識產權法律保護的問題。
論壇由澳門科技大學人文藝術學院汪藍副教授主持。澳門科技大學法學院助理教授、澳門創意共用項目(CC Macau)成員沈云樵在報告中就創意共用文本本地化過程中的法律問題提出看法,認為在本地化過程中應當最大程度尊重澳門本地法律。澳門維基協會周志堅會長從維基等網站的飛速發展指出,知識共享是未來發展的必然趨勢,是創意無限的基本前提。另一位報告人,澳門漫畫從業人員協會黃天俊會長就本澳及內地漫畫界發生的著名侵權事件進行分析,指出對於網絡作品的保護還遠遠不夠。評論人深圳大學法學院朱謝群教授認為,在目前對著作權保護遠遠不夠的前提下,共享可能是無法實現的理想,他又指出,協議文本在本地化時對本地文本的真正尊重并不是將協議中的作品範圍擴大至本澳法律所及的範圍,而是應將協議保留在原有範圍內。另一位評論人,澳門科技大學法學院易在成助理教授則認為,創意共用與著作權保護之間並不對立衝突,協議為作者對作品的使用提供了更加彈性開放的選項。
論壇在互動環節就網絡作品的使用和保護多方交流意見,期冀助力本澳文化創意產業的發展和著作權法律制度的完善,亦為兩岸四地以及澳葡文化創意產業的互動共進發揮作用。出席論壇的還有深圳大學法學院彭勃教授、澳門文化局文化創意產業促進廳鄺春媚高級技術員、澳門生產力暨科技轉移中心林濤經理、澳門科技大學法學院方泉副教授和湯曦小姐、通識教育部盧曉平講師和汪誠芳講師等。

CC Macau Attended the CC Global Summit in Warsaw

From September 16th to 18th, 2011, representatives from Creative Commons Macau (CC Macau), assistant professor Zaicheng Yi (legal team lead), Miss Xi Tang (public team) and Miss Chengfang Wang (language team) of Macau University of Science and Technology (MUST), participated in the Creative Commons (CC) Global Summit held in Warsaw, Poland.

The three-day summit provided an opportunity for CC volunteers, industry leaders and practitioners from more than 50 jurisdictions to gather together at Primates’ Palace, sharing successful porting experience and empowering an open future for the next decade.

During the summit, Assistant Professor Zaicheng Yi introduced CC Macau and their achievements to other affiliates at the regional meeting. More importantly, CC Macau learned about the new development of CC and gained experience from other CC affiliates. CC Macau team has decided to work closely with other CC affiliates, especially those in the Asia-Pacific region in fields like cooperating with government, open educational resources sharing and data sharing in science, etc. after the publication of localized CC licenses. Given the special legal situation in Macau, the local copyright law is about to be amended and both Chinese and Portuguese versions of CC licenses are required to publish. At the summit, CC Macau team made progress on drafting the Portuguese version of CC3.0 since Teresa Nobre, legal lead of CC Portugal promised future cooperation.

CC Macau is optimistic in their future development and fully aware of the importance of their role in assisting the Macau government to promote cultural and creative industries.

One of the key issues discussed at the conference was the preparation of the draft of CC 4.0 license. Despite its ambiguity and possible drawbacks, CC Macau will hold a positive attitude as they believe that a single global license for CC may well fit the increasingly globalized world today.

“創意共用”團隊(CC Macau)赴波蘭參加Creative Commons 全球峰會

2011 年9 月16 至18 日,Creative Commons(創意共用)組織全球峰會在波蘭首都華沙Primate Palace隆重召開。峰會聚集了全球五十多個不同司法管轄區近300名CC 組織成員,以及維基百科、Google 等全球組織參與。澳門科技大學支持的澳門“創意共用”團隊(CC Macau)受邀參會,法律組負責人澳門科技大學法學院易在成助理教授、語言組汪誠芳講師和公共組湯曦代表參加。

會議開幕當日,澳門“創意共用”團隊作為CC全球組織的新成員在峰會上發言,介紹團隊成立一年以來所做的工作。其他法域的CC團隊對CC Macau在短短時間內已完成文本第一稿表示讚許,而亞太地區分會更邀請澳門創意共用團隊加入亞太CC的互動平臺。澳門創意共用團隊同時亦了解到CC License 的新動向,尤其是CC4.0

版本與以前所有版本的本質區別,體現了更加國際化及開放的價值取向。參會期間,澳門創意共用團隊與眾多CC成員組織建立了聯繫,其中包括葡萄牙“創意共用”組織(CC Portugal),其法律組負責人Teresa Nobre 女士與澳門“創意共用”團隊在澳門CC3.0葡文版方面的合作達成基本意向。

本次全球峰會歷時三天,通過參加法律、語言、拓展及技術支援等不同的會議及與CC 總部及其他CC 團隊的交流,澳門“創意共用”團隊更加體會到Creative Commons 在互聯網環境下對知識傳播產生的深刻影響和長遠意義,同時也深刻認識到在澳門政府大力發展文化創意產業的背景下,澳門創意共用團隊必將在創意保護與共享領域發揮更大的作用。

CC Macau Project Team Invited to Expert Symposium on Creative Commons China Mainland 3.0 License Draft

On behalf of Creative Commons Macau (CC Macau), Assistant professor Shen Yunqiao of Faculty of Law, MUST was invited to attend Expert Symposium on Creative Commons China Mainland 3.0 License Draft, held in Mingde Law Building, Renming University of China on the afternoon of July 9th, 2011. This seminar was co-organized by School of Law and Intellectual Property School, Renming University of China and Creative Commons China Mainland (CC China).

Assistant Prof. Shen was invited to speak at the seminar. He presented his own views on the hot topics—the translation and definition of some key terms in the license draft such as “original author”, “publicly perform”, “work”, “distribute” etc., the non-commercial use of work, derivation of work and collective management of copyright. He also mentioned related problems CC Macau came across in the localization process of the licenses and shared experience as well.

After the seminar, Assistant Prof. Shen talked on behalf of CC Macau with Associate Prof. Wang Chunyan, leader of CC China, and Mr. Zhu Handong, project manager. They expressed willingness to have further exchange and cooperation in the near future.

Over 50 people participated in the seminar, including famous scholars, government officials, judges, lawyers, experts on internet and representative users of CC licenses. They conducted a thorough analysis on the draft content and contributed a lot of suggestions.

澳門“創意共用”項目組应邀參加 “CC3.0中國大陸版許可協議草案專家座談會”

2011年7月9日下午, “CC3.0中國大陸版許可協議草案專家座談會” 在中國人民大學明德法學樓舉行,此次會議由中國人民大學法學院、中國人民大學知識産權學院、知識共享中國大陸項目共同主辦。

知識共享中國大陸項目負責人、中國人民大學法學院王春燕副教授主持了座談會幷介紹了CC協議版本自2002年正式發布以來從1.0 版至3.0版的發展,重點報告了 “署名-非商業性使用-相同方式共享”CC 3.0中國大陸版許可協議草案的內容。這一草案在對CC3.0版未本地化協議文本進行翻譯的基礎上,根據中國大陸著作權法的相關規定,在鄰接權、原始作者、著作人身權等方面的規定上對協議做了調整,幷經知識共享組織總部審核,自2010年12月起進入公衆討論程序。

來自相關領域的學者、政府官員、法官、律師及互聯網等行業的專家、CC協議用戶代表等五十多人參加了座談會。著名知識産權專家、中國人民大學法學院郭壽康教授,北京市海澱區人民法院副院長宋魚水法官,國務院法制辦公室教科文衛司金武衛處長,中國音像作權協會馬繼超副總幹事、中國攝影家協會著作權工作委員會林濤秘書長,維詩律師事務所楊安進律師,中國人民大學知識産權學院張廣良副教授、張勇凡博士,清華大學法學院崔國斌副教授,以及網絡文化學者李慷等專業人士分別就草案的內容展開了全面、詳細的分析,提出了諸多創見和建議。

受知識共享中國大陸項目負責人王春燕副教授邀請,創意共用澳門項目代表、澳門科技大學法學院助理教授沈雲樵博士出席了會議。沈博士圍繞會議熱點探討的問題,如協議草案中“原始作者”、“公開表演”、“作品”、“發行”等重要概念的翻譯、表述、界定,以及非商業性使用、對作品的演繹、著作權集體管理等,提出了自己的見解,幷結合會議主題,向大會介紹了創意共用澳門項目在協議草案本地化過程中遇到的問題和積累的一些經驗。

會後,沈博士和CC中國大陸項目負責人王春燕副教授、項目經理朱捍東先生進行了會談。雙方表達了今後將進一步加强交流和合作,互通有無、取長補短的願景。受創意共用澳門項目負責人方泉副教授委託,沈博士向CC中國大陸項目發出了參與今年下半年舉辦的澳門CC3.0本地化版本協議草案專家論證會的邀請。

CC創意共用項目組拜訪澳門文化創意產業促進廳

2011年1月26日下午,CC創意共用項目組拜訪了澳門文化創意產業促進廳,就CC項目及文化創意共享在本澳的發展情況展開交流。文化創意產業促進廳陳炳輝廳長及廳內在知識產權、音樂與表演藝術、電影錄像與出版等多個文化範疇的同事參與了座談。

在聽取方泉副教授就CC項目的啟動緣由、應用及意義;沈云樵助理教授就CC項目法律文本本地化;汪藍副教授從創意人角度如何享用CC平臺進行資源共享與保護等分別進行介紹后,陳廳長對CC項目的工作表示贊許和支持,并表示CC項目與澳門文化創意產業目前構想設立一個服務于創意產業平臺的計劃有很多契合點,未來在創意產業共享方面很多交集處可以溝通探討,增進瞭解,共同推廣。雙方就本澳的文化創意產業進行了多角度的交流互動,最後在充滿中西方氣息的文化局大廳合影留念。

CC Macau’s Visit to Department for the Promotion of Cultural and Creative Industries

CC Macau Project Team paid a visit to the Promotion of Cultural and Creative Industries on the afternoon of January 26th, 2011, exchanging views on the development of creative industries in Macao. Director Chen Binghui and members engaged in fields like intellectual property right, music and performing arts, film recording and publishing all participated the brief meeting.

At the meeting, Associate professor Fang Quan talked about the cause, application and implication of initiating CC project in Macao, Assistant professor She Yun Qiao introduced the localization process and Associate professor Wang Lan shared his ideas of how to share and protect creative works on the platform of CC from the perspective of creative people. Director Chen showed great approval and support to what CC Macau project team has achieved, and remarked due to the conjunctions between CC Macau Project and the Department’s scheme of building a platform to serve the creative industries, there would be opportunities for the two sides to have further exchange and cooperation. The heated discussion ended with a group photo of the participants.

Seminar on Legal Protection of Cultural and Creative Works in Macau and CC Macau Project Held at MUST

The Seminar on Legal Protection of Cultural and Creative Works in Macau and CC Macau Project was held in Hall N317, Macau University of Science and Technology (MUST) on Thursday afternoon, November 25th, 2010. This seminar was co-organized by Faculty of Law and Socio-Cultural Research Institute of MUST.

The new Macao SAR government has been working on the moderate industrial diversification. In the newly released Policy Address for the fiscal year 2011, the policy of “moderate industrial diversification of Macao” was clearly stated. Creative Commons (CC), an organization originally established in the USA, has been devoted to building a reasonably layered and flexible mechanism for protecting copyright as well as sharing works. Porting CC licenses to Macao coincides with Macao SAR government’s current efforts to promote the development of cultural and creative industries (CCI).

CC licenses are reasonable and able to balance different rights, so ever since they were first released, more and more countries and regions have responded positively. Some organizations voluntarily cooperate with CC Headquarters to port CC licenses to their jurisdictions. At the moment, among the four regions across the straits, Mainland China, Hong Kong, and Taiwan have all ported the CC licenses into their jurisdictions and have entered the practical application stage. And in Portugal, Portuguese Catholic University has completed the porting process as the voluntary organization, and they have entered the public discussion phrase of version 3.0. Given the rapid development of Macao’s comprehensive strengths and the increasingly important role Macao plays in interregional cooperation and exchange, it’s highly necessary for Macao to fill in this blank, being an indispensible part of the four regions and a key platform for cooperation between China and Portugal. In view of this, Faculty of Law of MUST initiated CC Macau project early this year, hoping to provide a new, reasonable and effective form of legal protection for the smooth development of the CCI in Macao. It’s also CC Macau project’s aim to provide channels for copyright holders among culture, education and exhibition industries in Macao to share their creative works. According to CC Macau project leader, professor Fang Quan from Faculty of Law, MUST, due to the early productive preparation, MUST, as the local voluntary organization, signed MOU with the CC Headquarters this August and the project has been at the phrase of translation and adaptation of CC licenses, and the porting process is expected to complete next year. Then the CC licenses will be available for public use.

The seminar was held at an opportune time, receiving great support from all circles in Macao and Hong Kong. Participants include Consultant Zheng Xiaomin, The Intellectual Property Department of the Macao Economic Services, Consultant Peng Xian xin, Department for the Promotion of Cultural and Creative Industries, Cultural Affairs Bureau, Chairman Situ Zu cun, Macao Creative Industry Association, Chairman Zhou Zhijian, Wikimedia Macau Association, and guests from organizations like Macao Trade and Investment Promotion Institute, Culture & Art Association of Hong Kong, Macau and Taiwan, Macao Animation & Comic Culture Industrial Association, Macao Photography Association, Macao Youth Symphony Orchestra Association, CC Hong Kong, etc.. Besides, famous local individuals like Carlos Marreiros and Li Chun-yat were also present at the seminar. All participants joined the heated discussion about the significance of the establishment of CC Macau, the methods and neutrality of CC Macau, the status quo and future of the development of CCI in Macao, the status quo of the legal protection of cultural and creative works in Macau, and so on. They also hoped CC Macao would work as a public platform to contribute to the development of CCI, revising of copyright law in Macao and promoting the cooperation in developing CCI in the four regions across the straits.
